1. Introduction

Welcome to InfluencerArmor ("Service", "Platform"), operated by Blue Beach Media LLC ("Company", "we", "us", "our"). By accessing or using InfluencerArmor at influencerarmor.com and any associated subdomains, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

2. Service Description

InfluencerArmor is an AI-powered protection platform designed for influencers, content creators, and talent agencies. The Service provides:

• Brand Shield: Impersonator detection and fake collaboration identification.
• Reputation Radar: Monitoring of public mentions, sentiment analysis, and crisis detection alerts.
• Contract Analyzer: AI-powered review of brand deals, sponsorship agreements, and management contracts, including clause-by-clause risk assessment.
• Account Fortress: phishing detection.

3. Account Registration & Eligibility

To use the Service, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction.
• Provide accurate, complete, and current registration information.
• Maintain the security of your account credentials.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to refuse registration, suspend, or terminate any account at our sole discretion if we believe you have violated these Terms.

4. Subscription Plans & Billing

4.1 Plans

InfluencerArmor offers the following subscription tiers:

• Creator Shield — $29/month: Basic protection including brand monitoring, phishing detection, and limited contract analysis.
• Full Armor — $99/month: Complete protection including unlimited contracts, and priority support.
• Talent Agency — $499/month: Multi-creator management for up to 25 creators, agency analytics, custom rules, and API access.

4.2 Billing

All subscriptions are billed monthly and auto-renew on the anniversary of your subscription start date. Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, your access to paid features will continue until the end of your current billing period. No partial refunds are issued for unused time within a billing cycle.

4.4 Refund Policy

We offer a 7-day money-back guarantee for new subscribers. If you are unsatisfied with the Service within the first 7 days of your initial paid subscription, contact us at [email protected] for a full refund. This guarantee applies only to first-time subscriptions and does not apply to renewals, upgrades, or downgrades.

5. Free Trial

New users may be offered a 7-day free trial of the Full Armor plan. During the trial period, you will have access to all features included in the Full Armor tier.

• A valid payment method may be required to start the trial.
• If you do not cancel before the trial period ends, your subscription will automatically convert to a paid Full Armor plan at $99/month.
• You will be notified before the trial ends.
• Free trials are limited to one per user. Creating multiple accounts to obtain additional trials is prohibited.

6. Acceptable Use

You agree not to use the Service to:

• Harass, stalk, threaten, or intimidate any individual.
• File fraudulent or abusive DMCA takedown notices.
• Use generated DMCA letters for content you do not own or have rights to.
• Scrape, crawl, or automatically extract data from the platform via unauthorized means.
• Attempt to reverse-engineer, decompile, or otherwise access the source code of the Service.
• Interfere with or disrupt the Service or servers connected to the Service.
• Use the Service for any unlawful purpose or in violation of any applicable law.
• Create accounts under false identities or impersonate another person.
• Use the platform's monitoring tools to surveil individuals without legitimate protective purpose.

7. DMCA Services Disclaimer

InfluencerArmor provides tools to generate DMCA takedown notices and identify potential infringement of your intellectual property. However:

• We are not a law firm and do not provide legal advice.
• Generated DMCA letters are templates based on your input and should be reviewed before submission.
• We do not guarantee that any social media platform, hosting provider, or third party will act on a takedown notice.
• Filing a false DMCA notice may expose you to legal liability. You are solely responsible for the accuracy and legality of any notices you submit.
• For complex intellectual property disputes, we recommend consulting a licensed attorney.

8. Intellectual Property

8.1 Our Property

The Service, including its design, code, algorithms, AI models, brand name, logos, and documentation, is the property of Blue Beach Media LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

8.2 Your Content

You retain ownership of all content you upload to the Service, including contracts, images, and profile information. By uploading content, you grant us a limited, non-exclusive license to process, analyze, and store that content solely for the purpose of providing the Service to you.

9. Data Collection & Monitoring

By using the Service, you acknowledge and consent to the following:

• We scan publicly available information on social media platforms on your behalf to detect impersonation, mentions, and sentiment.
• We process contracts and documents you upload using AI models to provide analysis and risk assessments.
• All monitoring activities are limited to publicly available data and data you explicitly provide.

10. Third-Party Services

The Service integrates with and relies on third-party services, including but not limited to:

• Stripe: Payment processing. Your payment information is handled directly by Stripe and is subject to their terms of service.
• Social media platforms (Instagram, TikTok, YouTube, X/Twitter): Public data accessed for monitoring and impersonator detection.
• Brevo: Transactional email delivery.

We are not responsible for the availability, accuracy, or policies of third-party services. Changes to third-party APIs or terms may affect Service functionality.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or that it will detect all impersonators, breaches, or threats.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
• AI-generated contract analysis is informational only and does not constitute legal advice. You should consult a qualified attorney before making legal decisions based on our analysis.

12. Indemnification

You agree to indemnify, defend, and hold harmless Blue Beach Media LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to:

• Violation of these Terms or our Acceptable Use policy.
• Fraudulent, abusive, or illegal activity.
• Non-payment of subscription fees.
• Extended account inactivity (12+ months).

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes. You may request deletion of your data by contacting us.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
